Can I Stop a Power of Sale at the Last Minute?

Possibly, but the closer the lender gets to completing the sale, the fewer options you have and the less room there is for delays. A last-minute solution may still be possible, but the file has to be assessed immediately.

A Power of Sale can sometimes still be stopped late in the process, but everything depends on timing, the amount required, the available equity and whether the financing or funds can actually be completed before the lender moves to the next step.

Pay the Amount Required

If the lender will still accept reinstatement or payout, bringing in the required funds may resolve the immediate enforcement problem.

Refinance the Mortgage

If there is enough equity, replacement financing may allow the enforcing mortgage, arrears and costs to be paid out.

Use Private Financing

When conventional financing is too slow or no longer available, a private lender may sometimes be able to move more quickly.

Bring in Family Funds

Family assistance may sometimes provide the cash needed to reduce the amount that has to be refinanced or resolve part of the shortfall.

Sell Before the Lender Does

If there is still enough time, a voluntary sale may give you more control than allowing the lender to complete the Power of Sale.

Act Immediately

At the last minute, even a workable solution can fail simply because there is not enough time to complete the appraisal, approval and legal work.
